Terms of Use

1. Use of the Site

You may use the Site for your personal, non-commercial use: to learn about Char, view our menus, make reservations, order online, buy gift cards, and contact us. You agree not to:

• use the Site for any unlawful purpose or in violation of these Terms;
• attempt to gain unauthorized access to, interfere with, or disrupt the Site, its servers or any connected systems;
• use bots, scrapers or other automated means to access or copy the Site at scale;
• submit false, misleading, abusive, defamatory or unlawful content through our forms or surveys, or impersonate any person; or
• upload or transmit viruses or other harmful code.

2. Menus, prices, hours and availability

We try to keep the menus, prices, specials, promotions, hours and other information on the Site accurate and current, but they may change without notice and may contain errors. Items and specials are subject to availability. The menu, prices and terms presented in the restaurant at the time of your visit control. We reserve the right to correct errors and to change or discontinue any item, special or promotion at any time.

3. Allergens and dietary information

Our kitchen handles common allergens, including milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soybeans and sesame, and cross-contact can occur. Menu descriptions may not list every ingredient. Please tell your server about any food allergy or dietary restriction before ordering. Consuming raw or undercooked meats, poultry, seafood, shellfish or eggs may increase your risk of foodborne illness.

4. Alcohol

Alcoholic beverages are served only to guests 21 years of age or older with valid identification, in accordance with New York law. We reserve the right to refuse service.

5. Reservations, online ordering and third-party services

Reservations are provided through OpenTable, online ordering through Toast, and gift card purchases through PayPal. When you use these services, you are subject to the provider's own terms, policies and fees, and your transaction is completed on their platform. We are not responsible for the availability, accuracy or operation of third-party services. Large parties, private events and catering may be subject to separate agreements, deposits and cancellation policies, which we will provide to you in writing.

6. Gift cards and promotions

• Gift cards are redeemable for food and beverages at Char Steakhouse and Bar, 151 Bryant Pond Rd, Mahopac, NY. They are not redeemable for cash except where required by law, and cannot be reloaded unless we state otherwise.
• Gift cards purchased for value are subject to New York law, including its minimum validity period, and are not subject to dormancy or service fees.
• Treat gift cards like cash. We are not responsible for lost, stolen or damaged gift cards, or for their unauthorized use.
• Promotional or bonus gift cards (for example, cards given free with a gift card purchase) have no cash value and are subject to the restrictions and expiration dates stated in the promotion, such as one promotional card per table per visit, not valid on holidays, not valid for happy hour and not valid with other specials.
• Gift card purchases made online are processed by PayPal and are subject to PayPal's terms.

7. Communications and text messages

If you give us your email address or phone number and agree to receive messages, you consent to receive communications from us about your inquiry, event, application or, where you have opted in, offers and news. For text messages, message frequency varies and message and data rates may apply. Reply STOP to opt out and HELP for help. Consent to marketing messages is not a condition of any purchase.

8. Submissions and feedback

When you submit an inquiry, survey, application, review or other feedback, you represent that the information is accurate and yours to share. You grant Char a non-exclusive, royalty-free right to use feedback and survey responses to operate and improve our restaurant and Site. We will not publish your name alongside your survey responses without your permission.

9. Intellectual property

The Site and its content — including the Char name and logo, photographs, videos, menu descriptions, text, graphics and design — are owned by or licensed to Char Steakhouse Inc. and are protected by copyright, trademark and other laws. You may not copy, reproduce, distribute, modify or create derivative works from any Site content without our prior written permission, except to view and print pages for your personal, non-commercial use.

10. Third-party links

The Site contains links to websites and services operated by others, including OpenTable, Toast, PayPal, Google, Facebook, Instagram and Yelp. We do not control and are not responsible for their content, policies or practices. Your use of them is at your own risk.

12. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHAR STEAKHOUSE INC. AND ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY THIRD-PARTY SERVICE LINKED FROM IT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Char Steakhouse Inc. and its owners, officers, employees and agents from any claims, losses, damages and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.

15. Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Putnam County, New York, and you consent to their jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time by posting a revised version on this page with a new effective date. Your continued use of the Site after changes are posted means you accept the revised Terms.

17. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and Char regarding the Site.
